A DUI conviction or license suspension can have a tremendous impact on anyone’s life. If you’re a commercial truck driver, the consequences of a DUI will be even more significant. Losing your CDL could prevent you from making a living.

Everett CDL Violations: What to Know About License Suspensions & DUIs

In Washington, RCW 46.25.090 is the statute outlining the impact a DUI may have on your right to drive a commercial vehicle. Under this law, you may be “disqualified from driving a commercial motor vehicle for a period of not less than one year” if you’ve been convicted in any jurisdiction of a first violation of:

  • Operating a motor vehicle under the influence of alcohol or any drug;
  • Operating a commercial motor vehicle with a blood alcohol concentration of 0.04 or more;
  • Driving a commercial motor vehicle with any amount of THC concentration;
  • Driving a noncommercial motor vehicle with a BAC of 0.08 or more;
  • Driving a noncommercial motor vehicle with a THC concentration of 5.00 nanograms per milliliter of whole blood or more.

Certain details of this law may stand out to you. For example, to be convicted of a typical DUI, you need to have been driving with a BAC of 0.08 or more. However, if you’re operating a commercial motor vehicle, a BAC of 0.04 is enough to prohibit you from using your CDL for at least a year. Your CDL can also be jeopardized if you’re found guilty of driving a noncommercial motor vehicle under the influence of alcohol or THC. So, along with the various penalties you may face for a DUI conviction if you drive your own car while intoxicated, you might also lose your right to work as a commercial truck driver.

How an Everett CDL Lawyer Helps with DUI and License Suspension Issues

The strategy a lawyer will employ when defending you in these circumstances will vary depending on numerous factors. If you’re genuinely innocent of the crimes you’re accused of, your lawyer can demonstrate the prosecution doesn’t have a strong case against you.

That said, it’s important not to lie to your attorney. If you are guilty, your lawyer can reference your driving record and other such factors to show why your penalties shouldn’t be as harsh as it might otherwise be.

This isn’t an issue you can ignore. At Russell & Hill – Injury & Accident Attorneys, our Everett CDL violations attorneys are ready to start building your defense. The sooner we can begin, the better the outcome is likely to be for you. Call us at 800-529-0842 for more information.
