Shocking Accident: Worker Struck By 11000 Pound Steel Beam in Everett

Posted on : April 10, 2023Posted By : Matthew Russell

Construction workers put their lives on the line every time they go to work. However, that does not make dealing with work-related injuries or deaths easier to deal with. Construction workers still have their rights as employees. If their safety is jeopardized due to a third party’s negligence, they have the right to file a lawsuit against them. At Russell & Hill – Injury & Accident Attorneys our Everett construction injury attorneys are dedicated to ensuring you secure the compensation you deserve.

The Details Behind The Incident

An unidentified 45-year-old construction worker died while working on the State Route 520 Montlake project in Everett, Washington. At 5 p.m. on a Wednesday, an 11,000-pound steel beam pinned down the victim between a pillar and a flatbed trailer after striking him in the chest. Crewmates freed the 45-year-old from the steel beam and attempted to perform CPR. Unfortunately, he died while the paramedics rushed him to the hospital.

It was unknown whether or not the project would be put on hold or continue after the accident. At the time, it was also unknown whether or not the investigators from the Occupational Safety and Health Administration were aware of the accident.

How To Proceed Afterwards?

Dealing with work-related injuries or deaths can take a toll on victims and their families. It is a struggle that can be difficult to carry alone. An experienced attorney will lead the way and guide you through the process.

You are usually unable to file a lawsuit against your employer if an injury occurs on a construction site. You will have to rely on compensation made available through the state workers’ compensation system. However, you still may be eligible for compensation if there is proof of fault that a third party was negligent. It would need to be determined who exactly was at fault, whether that was the subcontractors, general contractors, the property owner, or the machinery manufacturer. Understanding who is liable is necessary for filing a lawsuit.

Consult a medical professional immediately after, so the injuries are documented as proof. Then, notify your employer of the accident. Gather any information available that can be of aid in your case. Gathering eyewitness contact information will come in handy when testimonies may be necessary for court. The attorneys can also use any photographs or videos of the scene and damage in court to serve as evidence.

According to OSHA, on average, over 100 deaths per week occur on the job per year. In addition, lack of safety equipment tends to be the root of work-related injuries. There is still work to do in promoting workplace safety in the US.

Your Rights Are Important To Us

Your job is how you provide for your family, and when that is taken away, you may be left with worries and despair. We understand that work is essential. That work gives you the means to live your life to the fullest. Construction workers are aware of how risky their job maybe, but that does not deem the outcome of a negligent construction worksite as justifiable. At Russell & Hill – Injury & Accident Attorneys our Everett construction site accident attorneys are ready to conduct a full investigation so compensation is secured.
