Under this law, you may be “disqualified from driving a commercial motor vehicle for a period of not less than one year” if you’ve been convicted in any jurisdiction of a first violation of:

  • Operating a motor vehicle under the influence of alcohol or any drug;
  • Operating a commercial motor vehicle with a blood alcohol concentration of 0.04 or more;
  • Driving a commercial motor vehicle with any amount of THC concentration;
  • Driving a noncommercial motor vehicle with a BAC of 0.08 or more;
  • Driving a noncommercial motor vehicle with a THC concentration of 5.00 nanograms per milliliter of whole blood or more.

Certain details of this law may stand out to you. For example, to be convicted of a typical DUI, you need to have been driving with a BAC of 0.08 or more. However, if you’re operating a commercial motor vehicle, a BAC of 0.04 is enough to prohibit you from using your CDL for at least a year.Your CDL can also be jeopardized if you’re found guilty of driving a noncommercial motor vehicle under the influence of alcohol or THC. So, along with the various penalties you may face for a DUI conviction if you drive your own car while intoxicated, you might also lose your right to work as a commercial truck driver.
