What does “Vacating A Misdemeanor in Washington State” mean?
Vacating a misdemeanor in Washington state means that if the court determines you meet certain conditions and orders such as if you pled guilty to a crime, your plea would be changed to “not guilty” and then the charges would be dismissed. If you were charged and found guilty, the court may set aside the conviction, dismiss your case and vacate the judgment and sentence. If your record was related to domestic violence, your name, the case number, and the charge may still show up on the Court’s information site.
When vacating a misdemeanor in Washington state, it does not remove your information from the Court’s record-keeping system. Your record remains in the Court system and is available to the public. Your record will be updated with additional information about the vacated record.
If you were arrested and fingerprinted, your record may still be maintained by the arresting department. If you have any questions regarding your arrest record, you should forward your request to the arresting department or agency. In Washington state, you are allowed to only have one conviction vacated, in most circumstances.
